LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Toryn M. Lane and Shayne Marie Pedercini to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Caliber Home Loans, Inc., its successors and assigns, dated July 8, 2021 and recorded in Hampshire County Registry of Deeds in Book 14180, Page 213 (the "Mortgage") of which mortgage NewRez LLC d/b/a Shellpoint Mortgage Servicing is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Caliber Home Loans, Inc., its successors and assigns to NewRez LLC D/B/A Shellpoint Mortgage Servicing dated November 28, 2023 and recorded at said Registry of Deeds in Book 15019, Page 39, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 108 Fisherdick Road, Ware, MA 01082 will be sold at a Public Auction at 11:00 AM on June 16, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: The land with the buildings and improvements thereon, in Ware, Hampshire County, Massachusetts, more particularly bounded and described as follows: On the westerly side of Fisherdick Road, being known and designated as Lot "E" as shown on a plan of land in Ware, Massachusetts, prepared for Joseph P. Albano by Almer Huntley, Jr. & Associated, Inc. Said plan recorded in Hampshire County Registry of deeds in Plan Book 137, Page 67. Subject to all notations, facts, issues and easements shown on Plan recorded in Plan Book 137, Page 67 of the Hampshire County Registry of Deeds. For mortgagor's title see deed recorded with the Hampshire County Registry of Deeds in Book 13459, Page 95. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
